These Terms & Conditions ("Terms") are a binding agreement between you and Adcam Advertising (Pty) Ltd ("we", "us", "our") governing your use of the K53 Examiner application and website (the "App"). By ticking the acceptance box, creating an account, or continuing to use the App, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the App.
You must accept these Terms before you can use the App. Your acceptance is recorded against your account together with the version of the Terms accepted, the date and time, and the browser you used. The current version is 2026-08-13.
When we materially change these Terms or the Privacy Policy, we publish a new version and ask you to accept it again the next time you open the App. If you decline, you may not continue using the App, but you may still request access to or deletion of your personal information.
The App is intended for learner-licence candidates in South Africa who are 16 years or older. If you are under 18, a parent or legal guardian must read and consent to these Terms and to the processing of your personal information described in the Privacy Policy. By using the App you confirm that you meet these requirements.
K53 Examiner is a private study aid for the South African learner's licence (K53) test. It is not affiliated with, endorsed by, licensed by or operated on behalf of the Department of Transport, the Road Traffic Management Corporation, any Driving Licence Testing Centre (DLTC), any provincial authority, or any examiner.
Our Content is prepared in good faith from publicly available road-traffic material, but official test content, question wording and pass standards may change without notice. Using the App does not guarantee that you will pass any official test. Always confirm current requirements with your DLTC before your appointment.
Nothing in the App is legal advice or driving instruction. Do not rely on it to decide what the law requires of you on a public road, and do not use the App while driving.
You must provide accurate registration information and keep your password confidential. Accounts are personal and may not be shared, sold or transferred. You are responsible for all activity under your account and must notify us immediately at support@k53examiner.co.za if you suspect unauthorised access.

Automated or fraudulent ad clicks are a material breach and may result in immediate termination.
All Content and all intellectual property in the App remain the property of Adcam Advertising (Pty) Ltd or its licensors. We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App and its Content for your own study only. No other rights are granted, whether by implication or otherwise.
If you send us feedback, corrections or problem reports, you grant us a free, perpetual licence to use them to improve the App.
The App is free to use and is funded by advertising. We display advertising banners supplied by us or by third-party advertisers.
When you tap an advertisement, we record that interaction — which banner was tapped, the date and time, the screen you were on, a coarse device category (phone, tablet or desktop) and your account identifier. We use this to report performance to advertisers, to bill them, and to detect fraudulent or automated clicks. This processing is described in the Privacy Policy and is a condition of using the free App.
Advertisements may link to third-party websites. We do not control and are not responsible for the content, products, offers, pricing or privacy practices of those websites. Any dealings you have with an advertiser are between you and that advertiser.
The App is currently provided free of charge. If we introduce paid features in future, the price, billing period and renewal terms will be shown clearly before you pay, and your rights under the CPA are not limited by these Terms.
We aim to keep the App available but do not warrant uninterrupted or error-free operation. We may add, change, suspend or remove features, content or the entire App at any time, and we may perform maintenance without notice.
You may stop using the App at any time and may permanently delete your account and data from Profile → Delete account. Deletion removes your profile, answers, test sessions, bookmarks and problem reports.
We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably suspect fraudulent activity, or if we are required to do so by law.
To the maximum extent permitted by South African law, the App and its Content are provided "as is" and "as available", without warranties of accuracy, fitness for a particular purpose or non-infringement.
We are not liable for indirect, incidental, special or consequential loss, loss of profit or data, for a failed official test, for reliance on Content, or for decisions you take on a public road. Where our liability cannot lawfully be excluded, it is limited to ZAR 1 000 or the total amount you paid us in the twelve months before the claim, whichever is greater.
Nothing in these Terms excludes liability for gross negligence, intentional misconduct, or any liability that may not be excluded under the CPA or other applicable law.
You indemnify Adcam Advertising (Pty) Ltd against any claim, loss, damage or cost arising from your breach of these Terms, your unlawful use of the App, or content you submit through the App.
You consent to receiving communications from us electronically, including service and account emails. Electronic records and acceptance logs constitute valid evidence in terms of ECTA.
If any clause is found unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver of it. You may not cede or assign your rights under these Terms; we may do so on notice, for example on a sale of the business.
These Terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts.
